When browsing this website (hereinafter the “Website”), Fondazione Piccolo Teatro di Milano - Teatro d’Europa may collect information about users which are personal data under the applicable Privacy Law.

This page provides the users of the Website with the information prescribed by both the articles 13 and 14 of the General Data Protection Regulation (EU) 2016/679 (hereinafter the “G.D.P.R”) and the adapting national law (hereinafter the entire regulatory framework will be referred as “applicable Privacy Law”).              
This privacy policy concerns only the Website (whose domain name is www.piccoloteatro.org/en/).  Other websites accessible by the user through the links they can find on the Website fall beyond the scope of this Privacy Policy.

 

  1. Identity and contact details of the Data Controller and Data Processor

Fondazione Piccolo Teatro di Milano - Teatro d’Europa (hereinafter the “Theatre”), with its registered office in via Rovello 2, 20121, Milano (MI), is the Data Controller. Within the Theatre organizational structure, Carmen Spiazzi born in Milan on 12 November 1964, and resident in Milan in via Mecenate, n. 107 (e-mailspiazzic@piccoloteatromilano.it; tel.:02.72.333.210), is the person accountable for the data processing (namely the Data Processor).

The Theatre has appointed a Data Protection Officer (D.P.O.) pursuant to article 37 G.D.P.R. The users can contact the D.P.O.  via this e-mail address: dpo@piccoloteatromilano.it.

 

  1. Personal Data treated by the Theatre

When the user browses the Website, the categories of personal data indicated below can be collected by the Theatre.
The user will bear responsibility for third parties’ personal data he has provided to the website. Therefore, the Theatre will bear no responsibility toward third parties for such data.

  1. Types of processed personal data
     
    • PERSONAL DATA PROVIDED DIRECTLY BY THE USER:
       
      • Data necessary to use the account and to make online purchase:
         
        • Data compulsory to create an account: For the user to register an account on the Website, the Theatre collects, as mandatory informations, the user's e-mail address, his / her name, his surname and the "username" chosen for the account (whose fields are marked with an asterisk). These data are necessary to purchase or book tickets online, as well as to purchase subscriptions online.
        • Data related to the account: The Theatre collects some information on how the user uses his account (such as, as a way of example, adding tickets to the cart).
        • Data on transactions: The Theatre collects information on the user transactions on the Website, including data on the payment instruments used (such as credit card expiry), date and time of payment and the amounts paid. These data are necessary to purchase or book tickets online, as well as to purchase subscriptions online.
      • Optional Data:
        • Non-compulsory data to create an account: If non-compulsory data to create an account are provided by the user while registering such account, the Theatre will collect these data. To not provide these data does not preclude the user to purchase or book tickets online, nor to purchase subscriptions online.
        • Data provided when requesting information by e-mail: When the user requires information by e-mail to the addresses indicated in the Website, the Theatre acquires the user's e-mail address and any other personal data that the user inserted explicitly and voluntarily in such e-mail.
        • Data provided through the newsletter service: If the user consents to the newsletter service of the Theater, the latter acquires the user's e-mail address and other behavioural data related to the status of the newsletter e-mail - i.e. information about the reception of the e-mail, the opening of it, and the use of its internal links by the user.

Whether the user shares news found on the Website via Facebook, Twitter or Google Plus, or whether he registers an account on the Website through his Facebook, Twitter or Google Plus profile, the Website may ask the user for some permissions to connect with Facebook, Twitter and Google Plus.
Such permissions, besides allowing the Website to connect with the user's profile on the aforementioned social networks, do allow the Website also to perform actions through the user's profile (such as, as a way of example, posting on Facebook about specific Theatre shows).

Such permissions also allow the Website to collect from these social networks a set of user personal data, varying accordingly to what the user permitted.

      User personal data are processed in order to:
      • resolve disputes with the user, or to recover from the user the sums necessary for the Theatre to provide via the Website the required services;
      • prevent or combat either fraud, security breach and prohibited activities.

 

  • TO PURSUE THE THEATRE LEGITIMATE INTERETS PROVIDED THESE LEGITIMTE INTERESTS DO NOT OVERRIDE THE INTERESTS AND FOUNDAMENTAL RIGHTS OF THE DATA SUBJECT
    User personal data are processed in order to:
    • identify and resolve problems encountered by the user in browsing on the Website (such as, as a way of example, blocked or non-working pages), and to provide a better browsing experience;
    • personalize and improve the advertising sent to the user by other websites, by taking account of the user's preferences recorded while browsing the Website;
    • collect aggregate statistical data on the number of users visiting the Website (as unique visitors) and on the modalities these users browse the Website;

  1. Modalities of data processing

 

The personal data processing will be carried out through computerized or telematic tools suitable to guarantee the security and confidentiality of those data.
The data processing will be performed by Theatre staff which is duly trained to comply with the applicable Privacy Law.

 

  1. Duration of data processing and data storage time limits


Pursuant to art. 30 G.D.P.R., the Theatre maintains a record of its processing activities.  Such document lists the specific durations of data processing.

In compliance with the criteria drawn up in recital 39 and article 5, paragraph 1, letter e) of the GDPR, personal data will be stored for the time which is necessary to perform the service requested by the user or to achieve the purposes aforementioned (see point 4) above)

The data storage shall not exceed the two years period anyway.

In compliance with recital 65 G.D.P.R., exceptions to data storage time limits may apply when the Theatre has to fulfill its legal and administrative obligations, or to assert its rights in judicial proceedings or to pursue other reasons of public interest (such as, as a way of example, to comply with public authorities’ orders).

When the storage periods expire, the user personal data are erased or permanently anonymized.

 

  1. Disclosure of personal data

Personal data disclosure to third parties can occur under the following circumstances:

  • the Theatre may disclose the user personal data to third parties providing services to the Theatre, especially those dealing with payments. Such disclosure is limited to what is necessary to satisfy the related processing purposes;
  • the Theatre may disclose the user personal data to third parties whose task is to prevent fraud and security breach, as well as other unlawful activities. Such disclosure is limited to what is necessary to satisfy the related processing purposes;
  • the Theatre may disclose user personal data to judicial authorities, public authorities or otherwise authorized third parties, either when provided by law, or whether such disclosure is reasonably necessary. In such circumstances, the disclosure will serve these purposes:
    • for the Theatre to fulfill its legal obligations;
    • for the Theatre to fulfill authorities’ requests in case of criminal investigation;
    • for the Theatre to enforce its rights, his employees’ rights, the user rights or the general public rights.
       
  1. User rights

Under the applicable Privacy law, the user can exercise the following rights without any constraint:
 

  1. the right to obtain confirmation of his personal data being processed by the Theatre;
  2. the right to access to his personal data;
  3. the right to know the origin and the purposes of the processing of his personal data, as well as their retention period (or at least to know the criteria to determine such period). The user does also have the right to know whom third parties his personal data are communicated to;
  4. the right to withdraw his consent at any time, if the consent is the legal basis for the processing. However, in such a case there will be no prejudice to the lawfulness of the processing carried out before the withdrawal;
  5. the right to have his personal updated or corrected, in order to make these data always accurate; 
  6. the right to obtain by the Theatre the erasure of his personal data (“right to be forgotten”) from the Theatre’s databases and/or archives, including backups;
    Such right can only be exercised where one of the following grounds applies:
    1. the personal data are no longer necessary in relation to the purposes which they were collected for;
    2. the user withdraws the consent which the data processing is based on;
    3. the user exercises the right to object to the processing, in the manners specified hereinafter;
    4. the applicable privacy law provides for such erasure;
    5. an unlawful data processing has occurred, and the user has been successful to demonstrate so;

Nonetheless, the Theatre will not carry out the erasure when the processing of user personal data is necessary for one of the reasons referred to in article 17, paragraph 3 of the G.D.P.R. (such as, as a way of example, when the law demands such processing, or for the pursuit of public interest needs);

  1. the right to have the data processing restricted when it does apply one of the grounds under art. 18, paragraph 1, GDPR;
  2. the right for the user to object to the processing of his personal data, when the processing is carried out to pursue public interests or the Theatre legitimate interests. Nonetheless, the Theatre could overcome this objection if it successfully demonstrates that the processing is necessary to pursue ineludible legitimate interests or to assert its right in judicial proceedings;
  3. to receive his personal data, collected by the Theatre for the aforementioned purposes, in a structured, commonly used, machine-readable and interoperable format. The user also has the right to provide such data to third parties, without any constraint;
  4. the right to be notified about any rectification or erasure of personal data or restriction of processing carried out by the Theatre. The user also has the right to be notified about any withdrawn of such measures as well as about the reasons why such withdrawn has occurred.


The Theatre will process the user’s request within one month form their reception.
Nonetheless, the deadline could be extended up to two months more on grounds of complexity and overload of the applications received by the Theatre. Should such circumstance occur, the Theatre will inform the user - within one month by the application submission - on the deadline extension and on the reasons of the extension.
The user can exercise his rights via written and informal request addressed to the following e-mail address spiazzic@piccoloteatromilano.it.
If the user is not satisfied about the way his application has been handled, he/she can lodge a complaint with the Data Protection Authority (http://www.garanteprivacy.it/) through the modalities provided for by the applicable Privacy Law.

The user can request the Theatre for additional information (on specific services) than those contained in this privacy policy.

The Theatre retains the right to amend this privacy policy at any time. Whether amendments occur, they will be published on this page. Therefore, we invite users to consult this page frequently in order to be updated on the amendments occurred.

Unless otherwise specified, the previous privacy policy will be applied to those personal data collected before the amendment.
